James Collins to sue GameStop for DLC

James Collins purchased Dragon Age: Origins from GameStop used for $54.95. The case advertised free Downloadable Content (DLC) and he expected to receive this free content. He later discovered that he could not access this free content (probably because it had already been used/accessed) and attempted to take it back to GameStop. They refused stating that he had already gone past his 7 day trial.
He ended up paying for the DLC which was $15. This resulted in Collins paying $10 more than if he had purchased the game new. Collins has filed a class-action lawsuit against GameStop in California. The lawsuit says:
What do you guys think? Do you think it is stupid for him to sue GameStop based on not receiving free content? Do you believe that GameStop was deceptive by not telling him?GameStop’s deceptive practices are compunded by the fact that consumers have only seven days to return a used videogame. Many consumers do not realize they do not have access to all of the advertised content until after the time to return the game has expired. GameStop, who makes more than 20% of its revenue and nearly $2 billion from the sale of used video games, is aware of this issue, and continues to fail to alert customers that this content is not available on used games… As a result of GameStop’s concealment, Plaintiff ultimately paid $10 more to purchase a used game than he would have had he purchased a brand new copy of the exact same game.
